Two years after the Supreme Court’s Alice decision, we’re starting to get some idea of its limits as well as its overall impact so far. In Q2 2016, NPE litigation increased by about 57% from the Q1 lull, continuing the recent pattern of high volatility in quarter-to-quarter litigation activity (see chart below).
